The Commission will be the main body responsible for the appointment of judges in the Supreme Court and the High Court.
The commission will have 6 members. These include the Chief Justice of India, the two most senior judges of the Supreme Court, two distinguished persons and a Union Law Minister.
The two dignitaries will be selected by the Prime Minister of India, the Chief Justice of India and the Leader of the Opposition in the Lok Sabha. One of the two persons will be Scheduled Caste, Scheduled Tribe, Other Backward Classes, Minority or Women. Any two members of the Commission may use a "veto" on an appointment made by the Commission if they feel that the person selected does not qualify or qualify to be a judge of the Supreme or High Court.
A recommendation to appoint persons selected by the Commission as judges will be sent to the President. If the President does not approve the selection of a person but the person has a majority of the members of the Commission in his favor, the Commission may appoint that person as a judge or re-send the recommendation of the same person to the President. The president is bound to approve a second time.

The Commission will seek the advice of the Chief Justice of the High Court for the appointment of judges in the High Court. The Chief Justice of the High Court will advise the Commission on the appointment following the recommendation of the two most senior judges of the respective High Court. The commission will also hold discussions with the concerned state governors and chief ministers for the appointment of high court judges.
